Privacy Statement (according to GDPR)

General Information and Notes

We take the protection of your personal data very seriously and are therefore anxious not only to provide you with a comprehensive online offer, but also to guarantee your right to informational self-determination. The german Federal Data Protection Act (BDSG) and the Telemedia Act (TMG) in particular serve as the legal basis.


Please refer to the imprint for the name and address of the person responsible within the meaning of the Federal Data Protection Act and other data protection regulations.


Legal basis of the processing

The legal basis for our company's processing operations is Art. 6 EU DSGVO.


Art. 6 I lit. a DSGVO is the legal basis for processing operations for which we obtain consent for a specific processing purpose.


If the processing of personal data is necessary for the fulfilment of a contract, as is the case for example with processing operations which are necessary for the delivery of goods or the rendering of another service or consideration, the processing is based on Art. 6 I lit. b DSGVO. The same applies to such processing processes that are necessary to carry out pre-contractual measures, for example in cases of enquiries about our products or services.


If our company is subject to a legal obligation which requires the processing of personal data, for example to fulfil tax obligations, the processing is based on Art. 6 I lit. c DSGVO.


Ultimately, processing operations could also be based on Art. 6 I lit. f DGVO. Processing operations which are not covered by any of the aforementioned legal bases are based on this legal basis if processing is necessary to safeguard a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject do not prevail.


Use of protocol data to protect our systems 

With every access to our offer, information is automatically collected by us or our web-provider. This information - also known as server log files - is of a general nature and does not allow any conclusions to be drawn about your person. They serve exclusively to protect our systems and to prevent abusive or fraudulent behaviour. Among other things:

  • the website from which you access our site (referrer URL) 
  • the IP address 
  • the date and time of access 
  • the web browser and web browser version and the operating system you are using 
  • The domain name of your Internet provider 
  • the amount of data transferred 


Data collection and use for contract processing or for opening a customer account

The use and payment of all offered services are permitted - if and so far technically possible and reasonable - without specification of any personal data or under specification of anonymized data or an alias. 

We collect personal data when you voluntarily provide it to us in connection with your order, when contacting us (e.g. via contact form or e-mail) or when opening a customer account. Which data is collected can be seen from the respective input forms. We use the data provided by you to process contracts and your enquiries. After complete processing of the contract or deletion of your customer account, your data will be blocked for further use and deleted after expiry of the retention periods under tax and commercial law, unless you have expressly consented to further use of your data.


Data transfer for contract fulfilment

For the fulfilment of the contract we pass on your data to the shipping company commissioned with the delivery, as far as this is necessary for the delivery of ordered goods. For the processing of payments, we pass on the payment data required for this to the credit institution commissioned with the payment and, if applicable, the payment service provider commissioned by us or to the payment service selected by you.


Revocation of your consent to data processing

You can revoke your consent at any time. All you need to do is send us an informal e-mail. The legality of the data processing up to the revocation remains unaffected by the revocation.


Data economy 

We store personal data in accordance with the principles of data avoidance and data economy only as long as it is necessary or prescribed by law (legal retention and storage periods). If the purpose of data storage no longer applies or if the storage period ends, we will block or delete the data.


Right to data transferability

You have the right to have data which we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another person responsible, this will only take place if it is technically feasible.


SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.


Information, blocking, deletion

You have the right to free information about your stored personal data, their origin and recipients and the purpose of data processing and, if necessary, a right to correction, blocking or deletion of this data at any time within the scope of the applicable legal provisions.


Right of appeal to the competent supervisory authority

In the event of breaches of data protection law, the person concerned has a right of appeal to the competent supervisory authority. The responsible supervisory authority for data protection issues is the North Rhine-Westphalia State Commissioner for Data Protection and Freedom of Information, P.O. Objection against advertising mails 

The use of published postal addresses, telephone or fax numbers and email addresses for marketing purposes is prohibited, offenders sending unwanted spam messages will be punished. The operators of these pages expressly reserve the right to take legal action in the event of unsolicited advertising information, such as spam e-mails.


Data collection on our websites


Newsletter

If you would like to receive the newsletter offered on our website, we need a valid e-mail address from you. We use the "double opt-in" procedure for registration to prevent you from entering our mailing list without your intervention. We will send an e-mail containing a link to the address you have provided. Only when you open this mail and click on the link, your consent is given.

We use these data exclusively for the dispatch of the requested information and do not pass them on to third parties.

You can revoke your consent to the storage of the data, the e-mail address and their use for sending the newsletter at any time, for example via the "Unsubscribe" function on this page or via the corresponding link in the newsletter.

CleverReach

For the dispatch of newsletters we use CleverReach. The provider is CleverReach GmbH & Co. KG, Mühlenstr. 43, 26180 Rastede. CleverReach is a service with which the newsletter dispatch can be organized and analyzed. The data you enter for newsletter subscription (e.g. e-mail address) will be stored on CleverReach's servers in Germany and Ireland.

Our newsletters sent out with CleverReach enable us to analyse the behaviour of newsletter recipients. Among other things, it is possible to analyze how many recipients have opened the newsletter message and how often which link was clicked in the newsletter. With the help of the so-called conversion tracking it can also be analyzed whether a pre-defined action (e.g. purchase of a product on our website) has taken place after clicking on the link in the newsletter. The data will be processed on the basis of your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time by cancelling the newsletter. The legality of the data processing processes already carried out remains unaffected by the revocation.

If you do not want CleverReach to analyze your data, you must also unsubscribe from the newsletter. The data you provide us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and deleted from both our servers and CleverReach's servers after you unsubscribe from the newsletter. Data stored by us for other purposes shall remain unaffected by this.

Information about cookies

To optimize our web presence, we use cookies. These are small text files stored in your computer's main memory. These cookies are deleting after you close the browser. Other cookies remain on your computer (long-term cookies) and permit its recognition on your next visit. This allows us to improve your access to our site.

Furthermore, Facebook makes your likes public for your Facebook friends. If you are logged into Facebook, it can assign the invocation of our page directly to your Facebook account. Even if you are not logged in or don't have a Facebook account, your browser sends information (e.g. which web pages you have called up, your IP address) which is then stored by Facebook. Web analysis with Google Analytics

This website uses Google Analytics, a web analysis service of Google Inc. (Google). Google Analytics uses cookies, i.e. text files stored on your computer to enable analysis of website usage by you. Information generated by the cookie about your use of this website is usually transmitted to a Google server in the United States and stored there. We use Google Analytics with the extension "anonymizeIP()". We also use Google Conversion Tracking, an analysis service provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"). Google Adwords also sets a cookie on your computer ("conversion cookie") if you have accessed our website via a Google ad. These cookies expire after 30 days and are not used for personal identification. If you visit certain pages of ours and the cookie has not expired, we and Google may recognize that someone clicked on the ad and was redirected to our page. Each AdWords customer receives a different cookie. Cookies can therefore not be traced through the websites of AdWords customers. The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. Use of Google AdSense

Use and application of YouTube

We have integrated components from YouTube on our website. YouTube is an Internet video portal that allows video publishers to post video clips and other users to view, rate and comment on them free of charge. YouTube allows the publication of all types of videos, which is why complete film and television programs, music videos, trailers or videos produced by users themselves can be called up via the Internet portal.

Each time one of the individual pages of this website is accessed, which is operated by the data controller and on which a YouTube component (YouTube video) has been integrated, the Internet browser on the information technology system of the person concerned is automatically prompted by the respective YouTube component to download a representation of the corresponding YouTube component from YouTube. In the course of this technical procedure, YouTube and Google are informed which specific subpage of our website is visited by the person concerned.
If the person concerned is logged on to YouTube at the same time, YouTube recognizes which specific subpage of our website the person concerned visits by calling up a subpage that contains a YouTube video. This information is collected by YouTube and Google and assigned to the respective YouTube account of the person concerned.


YouTube and Google receive information via the YouTube component that the person concerned has visited our website whenever the person concerned is logged on to YouTube at the same time as accessing our website; this happens regardless of whether the person concerned clicks on a YouTube video or not. Data Collection for Instant Messaging Services

We offer communication via WhatsApp or WhatsApp Business for the immediate consultation or estimation of stamps or coins. WhatsApp shares this information with other companies within and outside the Facebook group of companies. WhatsApp is certified under the Privacy-Shield Agreement (https://www.privacyshield.gov/participant?id=a2zt0000000TSnwAAG&status=Active) and thus offers the security of compliance with European data protection law.
Specifically, business-related contact
If you as a customer contact us via WhatsApp in order to ask business-related questions, e.g. the status of an order, the availability of goods or the receipt of a payment any data processing initiated on the part of the company, such as storing the telephone number and answering the request, regularly by Art. 6 para. 1 lit. b DSGVO, without requiring the prior consent of the enquirer. The data processing operations of the communication to be initiated serve directly to initiate and/or execute a contractual relationship. The same applies to the provision of further data (e.g. e-mail address, customer number, etc.) for the purpose of allocation to an order or identification.
General, non-business-related contact enquiries
If you, as a customer or interested party, use the WhatsApp number of Auktionshaus Felzmann in order to contact the Auktionshaus Felzmann with regard to general enquiries not relating to a specific business, the storage of the telephone number and its other processing for answering the enquiry is regularly based on our authorized interested party in accordance with Art. 6 Para. 1 lit. f DSGVO and does not require any special consent. In this case, the predominance of the entrepreneurial interest over the data subject's interest in the integrity of his data is safeguarded because you initiated the contact to our company yourself via WhatsApp and therefore implicitly initiated and agreed to the processing of your data to answer the inquiry.

Changes to our privacy policy

We reserve the right to occasionally adapt this data protection declaration so that it always meets the current requirements or to implement changes to our services in the data protection declaration. The new data protection declaration will then apply for your next visit.
